Terms of Service

1. Acceptance & Eligibility

By creating an account or using SOHK ("the Service"), you agree to these Terms. The Service is operated by AR Dynamics Inc, a Hawaii corporation, 200 N Vineyard Blvd, Ste A325 #5128, Honolulu, HI 96817. Contact: hello@ardynamicsinc.com. If you do not agree, do not use the Service.

You must be 18 or older. The Service is not for anyone under 18. You must be legally able to form a binding contract. If we learn that a user is under 18, we delete the account.

Age representation and warranty. By giving your birth month and year you represent and warrant that they are true and that you are 18 or older. Misrepresenting your age is a material breach of these Terms, and we may terminate the account under Section 17. When we delete an account because the holder is under 18, we keep only a minimal record: a pseudonymous account id, the deletion date, and the reason. That record holds no email, name, or study content, and is kept so we can show we acted. Payments by a person under 18: [DECISION NEEDED: minor refund wording, for example "we refund all payments made on the account".]

Signup, and the next sign-in for an account that has not yet confirmed this minimum, asks for the month and year you were born. We store that you met the minimum and when, not the birth date. If the answer is under 18, the account cannot be created or opened, and the question cannot be retried. An account that only affirmed an earlier 13-year-old minimum, and an account with no affirmation, must answer before the rest of the Service opens.

2. What SOHK Is — and Is Not

SOHK is an educational and entertainment study tool that uses AI "instructor" characters who deliberately adopt a harsh, satirical, tough-love persona to help you practice and retain material.

  • SOHK is not a licensed attorney, physician, nurse, accountant, financial adviser, broker, or mental-health professional, and provides no professional advice of any kind, in any subject track (including Law, Nursing/ Pharmacology, Financial Accounting, and Real Estate). No attorney–client, doctor–patient, fiduciary, or other professional relationship is created.
  • Content is AI-generated and may be inaccurate, incomplete, or outright wrong. You must independently verify everything against authoritative sources and your actual coursework before relying on it. Do not use SOHK output to make real legal, medical, financial, clinical, or professional decisions.
  • SOHK makes no guarantee of any outcome — including that you will pass any exam, course, bar, board, or licensing requirement.

3. Mature Content & Assumption of Risk (READ CAREFULLY)

You acknowledge and voluntarily accept that, especially in elevated-intensity modes you choose to enable, the Service is designed to be harsh and will use profanity; blunt and repeated mockery of your mistakes, reasoning, and excuses; and satirical personal remarks, including jokes about your abilities, your choices, and your career (e.g., suggesting you abandon your field for an unrelated trade).

You understand all such content is fictional satire delivered by a persona for pedagogical and entertainment purposes. It is not a statement of fact, not professional advice, and not a genuine judgment of your worth, intelligence, health, or prospects. You knowingly and voluntarily assume the risk of exposure to this content, you choose the intensity level, and you may reduce it or stop at any time. You agree you will not treat any output as a true factual assertion about you or any identifiable person.

What the product actually does. Scorched Earth (the harshest roast tier) and full, uncensored profanity stay off until you complete an in-app consent gate: five acknowledgements, all required, logged with your account, the terms version, and a timestamp. One of those boxes says "I confirm I am 18 or older." The server also requires a stored affirmation of that minimum before those modes can run. Without it, Scorched Earth is lowered and full profanity is not used, even if an older consent row exists. Profanity can be left off even if Scorched Earth is on. You can drop the intensity at any time. A distress message is answered with crisis resources before any roast continues.

4. Not a Crisis or Mental-Health Service

SOHK is not a counseling, crisis, or mental-health service. It is not a substitute for professional care. If you are in distress or considering harming yourself, stop and contact emergency services or a crisis line (in the US, call or text 988). You agree not to rely on SOHK in any mental-health emergency. Every SOHK instructor is an AI, not a human, and no human monitors chats. What the Service does when a message suggests a crisis is described at /safety.

5. Acceptable Use

You will not: use the Service if you are under 18; attempt to jailbreak, prompt-inject, or extract withheld answers; use it to cheat in violation of your institution's rules; resell or scrape the Service; or use it unlawfully. We may suspend or terminate accounts for violations.

No reverse engineering or scraping. The Service, its software, instructor prompts, question bank, flashcards and scoring are proprietary to AR Dynamics Inc. Except where applicable law expressly permits it despite this restriction, you will not reverse engineer, decompile, disassemble, deobfuscate, or otherwise try to derive the source code, prompts, models, answer keys, or scoring logic of the Service; and you will not scrape, crawl, harvest, or bulk-download the Service or its content (including the question bank and flashcards) by bot, script, or any automated means, or work around rate limits, plan limits, or access controls.

6. Billing, Subscriptions, and Refunds

Paid plans are offered only when the operator turns payments on. While they are off, the billing page states that there is no card on file and no paid plan, and SOHK does not collect subscription charges.

When payments are turned on, paid access is a subscription billed by Stripe:

  • Plans. Free: flashcards in up to 3 decks, 1 AI tutor session per day of up to 10 messages, 10 question-bank questions per week, no practice tests (Exam Sim), and no custom courses. Every free account gets every instructor and the full roast-intensity ladder; tiers never limit the personality. SOHK Plus: unlimited use of all of the above, at US $12.99 per month or US $89.99 per year, plus any applicable tax. Days and weeks reset at 00:00 UTC (weeks on Monday).
  • Free trial. A new Plus subscriber gets a 7-day free trial, one per account. You are not charged if you cancel before the trial ends; otherwise the first charge is taken when the trial ends and the subscription renews automatically from then on.
  • What you buy. A recurring subscription started in Stripe Checkout, monthly or yearly. The price and billing interval are shown on the billing page and at checkout before you pay.
  • Auto-renewal. The subscription renews automatically each billing period, at the price then in effect, until you cancel. You authorize Stripe to charge the payment method on file for each renewal. Before you pay, the billing page shows these renewal terms and how to cancel next to the pay button, and you must check an unchecked box agreeing to automatic renewal. We record that agreement with a timestamp and the version of these Terms. After purchase we email you a confirmation with the renewal terms and how to cancel.
  • Taxes. Applicable taxes, including Hawaii general excise tax where it applies, are shown at checkout.
  • Who holds the card. Stripe processes the payment. SOHK stores a Stripe customer id, plan status, and the current period end. SOHK does not store your full card number. The billing page says payments are processed by Stripe.
  • Cancel anytime. You may cancel online from the in-app billing page, which opens Stripe's billing portal. Cancellation is effective at the end of the current billing period. You keep paid access through that period, and the subscription does not renew afterward. The billing page also has a Cancel at period end button. Every cancellation SOHK sends sets "cancel at period end", and the billing portal is opened with a configuration that cancels at period end, not immediately.
  • Failed payments. If a renewal charge fails, paid access stops while the subscription is past due, until Stripe reports it active or trialing again. Update the card in the billing portal. A failed payment does not delete your account.
  • Price changes. Before a price change applies to your renewal, AR Dynamics Inc will email you at the address on your account no less than 7 and no more than 30 days before the change takes effect. The notice states the new price, when it applies, and how to cancel. You may cancel before it renews.
  • Refunds. Except where the law requires a refund, fees are not refunded for a partial billing period. Canceling stops the next renewal. It does not refund time already paid for in the current period.
  • Deleting an account. Deleting your account ends your subscription immediately: SOHK first cancels every live Stripe subscription (no further renewals, no new invoice), then deletes the Stripe customer, and stops the local deletion if Stripe does not confirm. Refund on deletion: none for the unused part of the current period, as in the Refunds bullet: the cancellation is not prorated and no credit is issued, except where the law requires a refund.
  • Price shown. The billing page and Stripe checkout show the actual price and billing interval, read from the configured Stripe Price. Payments stay off unless the operator also confirms the price-notice job is scheduled (PRICE_NOTICE_JOB_SCHEDULED=true).

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content is correct.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AR Dynamics Inc AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY EMOTIONAL DISTRESS, HURT FEELINGS, LOST PROFITS, OR EXAM/CAREER OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100.

Exclusions. Nothing in Sections 8, 9 or 10 limits or excludes liability for gross negligence, intentional or willful misconduct, or fraud, or for death or personal injury caused by negligence where the law forbids limiting it, and nothing in them waives any right that cannot be waived under applicable law, including non-waivable rights under Hawaii consumer-protection law (HRS chapters 480 and 481). Those limits apply only to the extent the law allows.

9. Release & Waiver

To the fullest extent permitted by law, you release AR Dynamics Inc from claims arising out of the mature/satirical nature of the persona output you voluntarily enabled and chose to receive, such as claims of insult, offense, hurt feelings, negligent infliction of emotional distress, or defamation of yourself based on that output. This release is limited to that content. It does not release claims arising from our gross negligence, intentional or willful misconduct, or fraud, claims about billing, data security or privacy, claims you did not know of when you agreed (to the extent the law protects unknown claims), or any right that cannot be waived by law (see Section 8, Exclusions).

10. Indemnification

You will indemnify and hold harmless AR Dynamics Inc from third-party claims, damages, and reasonable attorneys' fees arising from your misuse of the Service or your breach of these Terms. You do not have to indemnify us for claims to the extent caused by our own negligence, gross negligence, intentional or willful misconduct, or fraud, or where the law does not allow indemnity. We will tell you promptly about a claim, let you take part in its defense, and not settle it in a way that admits fault for you without your consent.

11. Dispute Resolution

Informal resolution first. Before starting arbitration, you and AR Dynamics Inc will try to resolve the dispute informally. The complaining party sends a written notice that describes the dispute and the relief sought. Send notices to hello@ardynamicsinc.com. We will send notices to the email on your account. The informal period is 30 days after the notice is received.

Binding individual arbitration. If the dispute is not resolved in those 30 days, it will be resolved by final, binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, not in court (except as this section allows). The seat of arbitration is Honolulu, Hawaii. You and AR Dynamics Inc waive any right to a jury trial.

Small claims. Either party may bring an individual claim in small-claims court in Honolulu County, Hawaii, if the claim qualifies, instead of arbitration.

Class action waiver. You and AR Dynamics Inc agree that claims will not be brought as a class, collective, or representative action, and that the arbitrator may not consolidate claims or preside over a class or representative proceeding. If a court holds the class waiver unenforceable as to a particular claim, that claim proceeds in court and the rest stay in individual arbitration.

Mass arbitration. If 25 or more similar demands are filed against AR Dynamics Inc (or by it) by or with the help of the same or coordinated counsel or organization within 180 days ("Mass Filing"), the following applies. (1) Batching: AAA administers the demands in batches of up to 50, one arbitrator per batch, and each batch is filed and paid only when the previous one is decided. (2) Bellwether: first, counsel for each side selects 10 demands (20 total) to proceed as bellwether arbitrations; the other demands are held, with any statute of limitations tolled, until the bellwethers are decided, and the parties then mediate the rest in good faith for 60 days before batching resumes. (3) Fees: AR Dynamics Inc pays the AAA filing, administrative and arbitrator fees that the AAA Consumer Rules assign to the business for each case actually being arbitrated; fees for held demands are not due until that demand is in an active batch. Nothing here makes you pay more than the consumer share under the AAA Consumer Rules. If a court finds this paragraph unenforceable as to a Mass Filing, those demands may proceed in court under Section 12 and the rest of this Section stays in effect.

30-day opt-out. You may opt out of this Section 11, including the class waiver, by emailing hello@ardynamicsinc.com within 30 days of first accepting these Terms. If we make a material change to this Section 11, the 30-day opt-out window restarts from the date you accept the changed Terms, for the changed terms. The email must come from or name the account email and clearly state that you opt out of arbitration. Opting out does not affect any other section.

Public injunctive relief. Nothing in this Section 11 waives your right to seek public injunctive relief in court where applicable law does not allow that right to be waived. Any such claim is stayed until the individual claims in arbitration are decided.

Under 18. The Service is only for people 18 or older. If we learn a user is under 18, we delete the account (Section 1).

12. Governing Law & Venue

These Terms are governed by the laws of the State of Hawaii, USA, without regard to conflict-of-law rules that would choose another state's law. Subject to Section 11, exclusive venue for any matter that is not arbitrated is the state and federal courts located in Honolulu County, Hawaii.

13. Changes to the Terms

We may update these Terms. We post the new version on this page with a new effective date. A material change applies to you only after you accept it: when the version changes, you are asked to accept at your next sign-in, and you can instead export your data, delete your account, or cancel. Version 1.2 changes the price-change notice (Section 6), adds the AI-instructor and safety notice (Section 4) and the public-injunctive-relief carve-out (Section 11), and removes acceptance by continued use. Version 1.3 adds the Free and Plus plans, their prices, and the 7-day free trial (Section 6), and the no-reverse-engineering and no-scraping clause (Section 5). Re-acceptance for everyone. When the Terms version changes, every account that accepted an older version sees an accept screen at its next sign-in or app load and cannot use the app until it checks the box. We record the version you accepted and the time. The Terms, Privacy Policy, Addendum and copyright pages, data export, account deletion, and sign-out stay available without accepting.

14. Severability & Entire Agreement

If any provision is held unenforceable, the rest remains in effect and the unenforceable provision is limited to the minimum extent necessary. These Terms, the SOHK Privacy Policy, the Student Content and Flashcards Addendum, and the in-app Scorched Earth consent record, are the entire agreement between you and AR Dynamics Inc about the Service. They replace any earlier agreements about the Service. If these Terms conflict with the Addendum about Student Content, the Addendum controls on that subject. If these Terms conflict with the Privacy Policy about what personal data is collected and why, the Privacy Policy controls on that subject. The Privacy Policy is at /privacy and the Addendum is at /addendum. The signup checkbox links all three.

15. Consent Record

Your acceptance of the Scorched Earth gate is recorded with your account id, the terms version, a timestamp, and which intensity and profanity options you enabled. This record is retained as evidence of your agreement and is removed when you delete the account. It is not a date of birth. The separate age affirmation records that you confirmed you are 18 or older.

16. Your Content, AI Output, and SOHK Property

Your content. You keep ownership of the notes, files, answers and other material you upload or type ("Your Content"). You give AR Dynamics Inc a non-exclusive, worldwide, royalty-free license to host, copy, process and display Your Content only to operate and provide the Service to you. That license ends when you delete the content or your account, except for copies in backups until they expire under our backup schedule and copies we must keep under a legal hold. We do not use Your Content to train AI models without your separate, opt-in consent.

AI output. To the extent any rights exist in AI-generated output produced for you, AR Dynamics Inc assigns them to you. Output may be similar to output for other users, and no rights are assigned in third-party material or SOHK property.

SOHK property. The Service, its software, characters, personas, roast banks, researched flashcards, designs and trademarks belong to AR Dynamics Inc and its licensors; all rights not granted are reserved. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial study while these Terms are in effect.

17. Termination

By you. You may stop using the Service and delete your account at any time from the account page. Deletion ends any subscription immediately (Section 6).

By us. We may suspend or terminate your account for a material breach (including misrepresenting your age, Section 1) or unlawful use, with notice to your account email where practical, or without cause on at least 30 days' notice.

Effect. On termination there are no further renewals. If we terminate without cause, we refund the pro-rata unused part of the current paid period. Termination for cause gets no refund except where the law requires one. Unless the law prevents it, you have 30 days after a notice of termination (or until the account is deleted, if earlier, when you delete it yourself) to download your data with the in-app export. Sections 7–12, 14 and 16 (other than the licenses to you) survive.

18. Copyright (DMCA)

We respond to notices of claimed copyright infringement under 17 U.S.C. § 512. The procedure for notices and counter-notices is at /dmca. Repeat infringers: an account that receives 3 valid notices (strikes) within 12 months is terminated. A strike that is withdrawn or successfully countered does not count. Our designated agent, AR Dynamics Inc, is registered with the U.S. Copyright Office.
